Privacy Policy

INTRODUCTION

My Life My Voice Charitable Trust (we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information, including health information.  Personal information is information about an identifiable individual (a natural person). 

We provide services that connects disabled people with other disabled people in similar situations] to obtain support and assistance.

If you access or use our Services (as those terms are defined in our Terms of Use), you authorise us to collect and use your personal and health information in accordance with:

This policy sets out how we will collect, use, disclose and protect your personal and health information.  This policy applies to all users of our Services (as that term is defined in our Terms of Use), including individuals who use the Services to access support services and any Supporter.  It covers personal and health information that we collect from users of our Services, Supporters, and other persons with whom we deal directly.

This policy does not limit or exclude any of your rights under the Act and the Code. 

You do not have to give us any information or provide us with full information.  But if you do not, we may refuse or be unable to provide you with all or part of the Services.

CHANGES TO THIS POLICY

We may change this policy by uploading a revised policy onto the Services.  The change will apply from the date that we upload the revised policy.

CHILDREN

We do not intend to collect personal and health information from or about children aged under 16.  If you have reason to believe that we have collected personal information from or about a child under the age of 16, please contact us at admin@mylifemyvoice.org.nz.

 

WHO DO WE COLLECT YOUR PERSONAL AND HEALTH INFORMATION FROM

We collect personal and health information about you from:

▲         you, when you provide that personal and health information to us, including via the Services, through any registration or subscription process, or through any contact with us (e.g. telephone call or email).  This information may be collected in a variety of ways, including via the phone, face to face, email, and via the Services.

▲         third parties where you have consented to this, or the information is publicly available. 

If possible, we will collect personal information from you directly. 

 

WHAT TYPES OF PERSONAL AND HEALTH INFORMATION DO WE COLLECT

We collect, hold and process the following types of personal information.

▲         a description of yourself which may include information about your general health and disabilities

▲         name and location

 

We will collect personal and health information only for purposes linked to our organisational functions.

 

HOW WE USE YOUR PERSONAL INFORMATION

We will only collect and use personal information for purposes linked to our organisation functions. 

We will use your other personal information:

▲         to verify your identity

▲         to provide services and products to you, including by obtaining information of your disability and lifestyle to enable us and any Supporter to better understand your needs

▲         to provide it to a Supporter that you have engaged with to enable them to provide you with support services, including to plan and carry out safe and appropriate support for your individual needs 

▲         to market our services and products to you, including contacting you electronically (e.g. by text or email for this purpose)

▲         to improve the services and products that we provide to you

▲         to respond to communications from you, including a complaint

▲         to conduct research and statistical analysis (on an anonymised basis)

▲         to protect and/or enforce our legal rights and interests, including defending any claim

▲         for any other purpose authorised by you or the Act.

 

DISCLOSING YOUR PERSONAL INFORMATION

We may disclose your health information to:

▲         a person who can require us to supply your personal information (e.g. a regulatory authority)

▲         any other person authorised by the Act or another law (e.g. a law enforcement agency)

▲         any other person with your consent.

We may disclose your other personal information to:

▲         any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products

▲          

▲         other third parties (for anonymised statistical information)

▲         a person who can require us to supply your personal information (e.g. a regulatory authority)

▲         any other person authorised by the Act or another law (e.g. a law enforcement agency)

▲         any other person authorised by you.

A business that supports our services and products may be located outside New Zealand.  This may mean your personal information is held and processed outside New Zealand. 

We may transfer your personal and health information in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition.  However, we will seek to ensure the same protections apply to that information on transfer as apply under this policy.

Anonymised data may be used for the purposes of research, audit or to provide analytics for us, Supporters, healthcare providers, healthcare funders and the Ministry of Health.

 

PROTECTING YOUR PERSONAL INFORMATION

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse.

 

ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information.  Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction.  If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

If you want to exercise either of the above rights, email us at admin@mylifemyvoice.org.nz.  Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).

We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

 

RETENTION OF PERSONAL INFORMATION AND HEALTH INFORMATION

We will keep your personal and health information no longer than is needed to fulfil the purposes for which it was collected.

 

INTERNET USE

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

If you post your personal information on the Service’s message board/ chat room, you acknowledge and agree that the information you post is publicly available.

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information.  We suggest you review that site’s privacy policy before you provide personal information.

 

COOKIES

We may use cookies (an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) to monitor your use of the website.  You may disable cookies by changing the settings on your browser.
